Modifying A Support Order

Either party has the right to have the case reviewed every three (3) years from their last order.  A party, or their respective attorneys, may also file a Petition for Modification before the three (3) year review if he or she believes there is a material change in circumstances which may impact the current level of support. It is the petitioning party’s burden to prove the change in circumstance.  A Petition for Modification is to be filed through E-Services on the Pennsylvania Child Support Website (www.childsupport.state.pa.us) or in person at the Domestic Relations Office if you do not have access to a computer to file. Once a signed petition is received, a modification conference is scheduled. If known, the parties’ attorneys are notified of the conference. The parties will be sent a packet of information to return to the Domestic Relations Office regarding their financial circumstances. Any reported employers will also be subpoenaed for income information. Filing a Petition for Modification does not guarantee that an Order will be modified in the manner the filer requests.

Terminating A Support Order

Parties or their respective attorneys may file a Petition to Terminate current support if there is reason to do so by filing a Petition for Modification to Terminate Current Support. A Petition for Modification to Terminate Current Support is to be filed through E-Services on the Pennsylvania Child Support Website (www.childsupport.state.pa.us) or in person at the Domestic Relations Office if you do not have access to a computer to file. Once a signed Petition is received, a modification conference is scheduled. If known, the parties’ attorneys are notified of the conference. The parties will be sent a packet of information to return to the Domestic Relations Office regarding their financial circumstances. Any reported employers will also be subpoenaed for income information. Filing a Petition for Modification to Terminate does not guarantee that an Order will be modified in the manner the filer requests. Any court fees the Defendant has accrued will need to be paid prior to the case closing.
