Probation with Restrictive Conditions

In Pennsylvania, a sentence of Probation with Restrictive Conditions (PRC) is an alternative to sentences that include incarceration. The restrictive conditions can be served in partial confinement programs such as work release or halfway house facilities, house arrest with electronic monitoring, or residential in-patient drug and alcohol treatment. Starting in 2020, as a direct result of the pandemic, Adams County began to utilize PRC sentences with house arrest as the restrictive condition in order to avoid incarceration. PRC sentences with house arrest are commonly used for DUI offenders. Per Title 42: 963(c) any person receiving a penalty pursuant to DUS 1543(d) and DUI 3804 1st, 2nd, 3rd may only have probation imposed after undergoing a drug and alcohol assessment. Additionally, PA DUI offenders are also required to participate and complete a CRN prior to sentencing.

Probation has a process to accept applications early in the defendant’s entry into the justice system and ideally within 5 days of their preliminary hearing. Upon receipt of the application, the defendant will be referred for a drug and alcohol assessment, CRN evaluation, and if needed a risk/needs assessment. Failure to attend any scheduled appointments may result in ineligibility for a PRC sentence.

Individuals that are sentenced to a restrictive term at Adams County Adult Correction Complex may be applicable for work release program.
